Bank Street Cyclist dies in Ottawa Accident with Cement Truck

July 30, 2013-  A tragic accident on Bank Street near Billings Bridge in Ottawa has resulted in the death of a 56 year old woman whose name has not been released.

Although the details of the accident are still emerging, it appears that the truck made a right hand turn while travelling south on Bank Street while the cyclist was traveling south through the intersection.  This is a common scenario for both bicycle and pedestrian accidents.

Is there a claim after a fatal truck – bicycle Ottawa accident?

After an Ottawa accident resulting in a fatality, the police typically perform a very detailed investigation to determine what happened.  Often the family of the deceased or injured person will also consult a forensic engineer to gather their own information about how such a accident occurred.  A personal injury lawyer can assist a grieving family in retaining and directing the engineer regarding what facts should be gathered for a future claim.

Similarly, a family considering a claim may wish to engage an investigator to gather witness statements.  Once the facts of the accident are clear, a personal injury lawyer can advise the family whether there is a claim for damages for the loss of their loved one.  In many instances where the claim involves a cyclist or a pedestrian, the motor vehicle driver will be held responsible for the accident.  This is because the Highway Traffic Act shifts the onus of proof onto a motorist to disprove negligence.

If you or a loved one has been involved in a motor vehicle – bicycle accident, you should contact a personal injury lawyer for your free no obligation consultation.  Call the  Ottawa personal injury lawyers at Auger Hollingsworth for more information or to schedule a free consultation at 613 -233-4529.
